Enforcing Immigration laws Essay

It is a 10 pages paper with 6 works cited. In this paper we will discusses some of the important issues related to immigration laws. We will discuss U. S. federal laws which cover the issue of illegal entry into this country. How they are involved in acquiring jobs illegally. To what extent the law enforcement of federal immigration laws falls under the duties and responsibilities of a local police office. Introduction Debate over illegal immigration and policy to control such an activity, is not new to the nation’s history. Much in the way of policies and procedures has changed; one aspect, however, has remained constant: the existence of illegal immigration. It’s been long that Congress debated legislation to control the immigration problem. As illegal immigration is raising more, laws will be carried out demanding to release some of the pressure. Undocumented individuals offer cheaper labor to businesses. These individuals do not get minimum wage, but instead they get paid lower, this gives the business an edge over other competitors by facilitating the employers. , Laws concerning Illegal Immigration United States federal laws have defined specific criteria for distinguishing between legal and illegal immigrant. The claws are as follows (a) Except as provided in subsection (b) and subsection (c) no immigrant shall be admitted into the United States unless at the time of application for admission he (1) has a valid unexpired immigrant visa or was born subsequent to the issuance of such visa of the accompanying parent, and (2) presents a valid unexpired passport or other suitable travel document, or document of identity and nationality, if such document is required under the regulations issued by the Attorney General. With respect to immigrants to be admitted under quotas of quota areas prior to June 30, 1968, no immigrant visa shall be deemed valid unless the immigrant is properly chargeable to the quota area under the quota of which the visa is issued. Illegal Employment An individual must have a valid Social Security Number to legally work and live within any of the United States state. Non citizens, needs to get an authorization from the Department of Homeland Security to work according to US laws. However on the other hand there a numerous illegal immigrants seek and engage in work devoid of authorization from the government. The United States has laws requiring individuals to have legal documentation, mostly intended to stop the employment of illegal immigrants. The penalties against employers are not always enforced consistently, which means that employers can easily use illegal labor. Undocumented immigrants are especially popular with employers as they can easily abuse them by violating minimum wage laws protected in the knowledge that illegal workers dare not report their employers to the police. It is a crime to hire an immigrant, to employ an immigrant, or to refer an immigrant for a fee, knowing the immigrant is not permitted to work in any state of America. It is farther a crime to let the illegal immigrant work intentionally knowing that the person is not permitted to work. In most of the cases the employers preferably employ or recruit an illegal immigrant as compared to an American national they can easily be exploited. It is illegal to employ an individual for a job in the United States without complying with work eligibility verification requirements defined by the federal law. Requisites include inspection of identity documents and submission of Form I-9 for each worker hired. Employers should keep in record of I-9s Form of every individual employed as they are bound to present it to federal legislatives if asked. Employment embraces all sorts of work or labor performed for any type of compensation within America, with the excluding sporadic domestic service any individual in a private home. Day laborers or other casual workers involved in any remunerated activity are workers for purposes of immigration law. An employer is an agent or an individual involved directly or indirectly in the benefit of the worker. For purposes of verification of authorization to work, employer also means an independent contractor, or a contractor other than the person using the alien labor. The use of temporary or short-term contracts cannot be used to circumvent the employment authorization verification requirements. If employment is to be for less than the usual three days allowed for completing the I-9 Form requirement, the form must be completed immediately at the time of hire.

The Lust Lizard of Melancholy Cove Chapter 1

This one's for Mom Prologue September in Pine Cove is a sigh of relief, a nightcap, a long-deserved nap. Soft autumn light filters through the trees, the tourists go back to Los Angeles and San Francisco, and Pine Cove's five thousand residents wake up to discover that they can once again find a parking place, get a table in a restaurant, and walk the beaches without being conked by an errant Frisbee. September is a promise. Rain will come at last and turn the golden pastures around Pine Cove green, the tall Monterey pines that cover the hills will stop dropping their needles, the forests of Big Sur will stop burning, the grim smile developed over the summer by the waitresses and clerks will bloom into something resembling real human expression, children will return to school and the joy of old friends, drugs, and weapons that they missed over the summer, and everyone, at last, will get some rest. Come September, Theophilus Crowe, the town constable, lovingly clips the sticky purple buds from his sensimilla plants. Mavis, down at the Head of the Slug Saloon, funnels her top-shelf liquors back into the well from whence they came. The tree service guys, with their chain saws, take down the dead and dying pines lest they crash through someone's roof with the winter storms. Woodpiles grow tall and wide around Pine Cove homes and the chimney sweep goes to a twelve-hour workday. The sunscreen and needless souvenir shit shelf at Brine's Bait, Tackle, and Fine Wines is cleared and restocked with candles, flashlight batteries, and lamp oil. (Monterey pine trees have notoriously shallow root systems and an affinity for falling on power lines.) At the Pine Cove Boutique, the hideous reindeer sweater is marked up for winter to await being marked back down for the tenth consecutive spring. In Pine Cove, where nothing happens (or at least nothing has happened for a long time), September is an event: a quiet celebration. The people like their events quiet. The reason they came here from the cities in the first place was to get away from things happening. September is a celebration of sameness. Each September is like the last. Except for this year. This year three things happened. Not big things, by city standards, but three things that coldcocked the beloved status quo nonetheless: forty miles to the south, a tiny and not very dangerous leak opened in a cooling pipe at the Diablo Canyon Nuclear Power Plant; Mavis Sand advertised in Songwriter magazine for a Blues singer to play through the winter at the Head of the Slug Saloon; and Bess Leander, wife and mother of two, hung herself. There were seven Shaker chairs hung on pegs on the walls of the Leanders' dining room. The eighth was overturned under Bess, who hung from the peg by a calico cloth rope around her neck. Dried flowers, baskets of various shapes and sizes, and bundles of dried herbs hung from the open ceiling beams. Theophilus Crowe knew he should be doing cop stuff, but he just stood there with two emergency medical technicians from the Pine Cove Fire Department, staring up at Bess as if they were inspecting the newly installed angel on a Christmas tree. Theo thought the pastel blue of Bess's skin went nicely with her cornflower-blue dress and the patterns of the English china displayed on simple wooden shelves at the end of the room. It was 7 A.M. and Theo, as usual, was a little stoned. Theo could hear sobs coming from upstairs, where Joseph Leander held his two daughters, who were still in their nightgowns. There was no evid-ence of a masculine presence anywhere in the house. It was Country Cute: bare pine floors and bent willow baskets, flowers and rag dolls and herb-flavored vinegars in blown-glass bottles; Shaker antiques, copper kettles, embroidery samplers, spinning wheels, lace doilies, and porcelain placards with prayers from the Dutch. Not a sports page or remote control in sight. Not a thing out of place or a speck of dust anywhere. Joseph Leander must have walked very light to live in this house without leaving tracks. A man less sensitive than Theo might have called him whipped. â€Å"That guy's whipped,† one of the EMTs said. His name was Vance McNally. He was fifty-one, short and muscular, and wore his hair slicked back with oil, just as he had in high school. Occasionally, in his capacity as an EMT, he saved lives, which was his rationalization for being a dolt the rest of the time. â€Å"He just found his wife hanging in the dining room, Vance,† Theo pronounced over the heads of the EMTs. He was six-foot-six, and even in his flannel shirt and sneakers he could loom large when he needed to assert some authority. â€Å"She looks like Raggedy Ann,† said Mike, the other EMT, who was in his early twenties and excited to be on his first suicide call. â€Å"I heard she was Amish,† Vance said. â€Å"She's not Amish,† Theo said. â€Å"I didn't say she was Amish, I just said I heard that. I figured she wasn't Amish when I saw the blender in the kitchen. Amish don't believe in blenders, do they?† â€Å"Mennonite,† Mike said with as much authority as his junior status would afford. â€Å"What's a Mennonite?† Vance asked. â€Å"Amish with blenders.† â€Å"She wasn't Amish,† Theo said. â€Å"She looks Amish,† Vance said. â€Å"Well, her husband's not Amish,† Mike said. â€Å"How can you tell?† Vance said. â€Å"He has a beard.† â€Å"Zipper on his jacket,† Mike said. â€Å"Amish don't have zippers.† Vance shook his head. â€Å"Mixed marriages. They never work.† â€Å"She wasn't Amish!† Theo shouted. â€Å"Think what you want, Theo, there's a butter churn in the living room. I think that says it all.† Mike rubbed at a mark on the wall beneath Bess's feet where her black buckled shoes had scraped as she convulsed. â€Å"Don't touch anything,† Theo said. â€Å"Why? She can't yell at us, she's dead. We wiped our feet on the way in,† Vance said. Mike stepped away from the wall. â€Å"Maybe she couldn't stand anything touching her floors. Hanging was the only way.† Not to be outdone by the detective work of his protg, Vance said, â€Å"You know, the sphincters usually open up on a hanging victim – leave an awful mess. I'm wondering if she actually hanged herself.† â€Å"Shouldn't we call the police?† Mike said. â€Å"I am the police,† Theo said. He was Pine Cove's only constable, duly elected eight years ago and reelected every other year thereafter. â€Å"No, I mean the real police,† Mike said. â€Å"I'll radio the sheriff,† Theo said. â€Å"I don't think there's anything you can do here, guys. Would you mind calling Pastor Williams from the Presby-terian church to come over? I need to talk to Joseph and I need someone to stay with the girls.† â€Å"They were Presbyterians?† Vance seemed shocked. He had really put his heart into the Amish theory. â€Å"Please call,† Theo said. He left the EMTs and went out through the kitchen to his Volvo, where he switched the radio over to the frequency used by the San Junipero Sheriff's Department, then sat there staring at the mike. He was going to catch hell from Sheriff Burton for this. â€Å"North Coast is yours, Theo. All yours,† the sheriff had said. My deputies will pick up suspects, answer robbery calls, and let the Highway Patrol investigate traffic accidents on Highway 1, that's it. Otherwise, you keep them out of Pine Cove and your little secret stays secret.† Theo was forty-one years old and he still felt as if he was hiding from the junior high vice principal, laying low. Things like this weren't supposed to happen in Pine Cove. Nothing happened in Pine Cove. He took a quick hit from his Sneaky Pete smokeless pot pipe before keying the mike and calling in the deputies. Joseph Leander sat on the edge of the bed. He'd changed out of his pajamas into a blue business suit, but his thinning hair was still sticking out in sleep horns on the side. He was thirty-five, sandy-haired, thin but working on a paunch that strained the buttons of his vest. Theo sat across from him on a chair, holding a notepad. They could hear the sheriff's deputies moving around downstairs. â€Å"I can't believe she'd do this,† Joseph said. Theo reached over and squeezed the grieving husband's bicep. â€Å"I'm really sorry, Joe. She didn't say anything that would indicate she was thinking about doing something like this?† Joseph shook his head without looking up. â€Å"She was getting better. Val had given her some pills and she seemed to be getting better.† â€Å"She was seeing Valerie Riordan?† Theo asked. Valerie was Pine Cove's only clinical psychiatrist. â€Å"Do you know what kind of pills?† â€Å"Zoloft,† Joseph said. â€Å"I think it's an antidepressant.† Theo wrote down the name of the drug on his notepad. â€Å"Then Bess was depressed?† â€Å"No, she just had this cleaning thing. Everything had to be cleaned every day. She'd clean something, then go back five minutes later and clean it again. She was making life miserable for the girls and me. She'd make us take our shoes and socks off, then wash our feet in a basin before we came into the house. But she wasn't depressed.† Theo wrote down â€Å"crazy† on his notepad. â€Å"When was the last time Bess went to see Val?† â€Å"Maybe six weeks ago. When she first got the pills. She really seemed to be doing better. She even left the dishes in the sink overnight once. I was proud of her.† â€Å"Where are her pills, Joseph?† â€Å"Medicine cabinet.† Joseph gestured to the bathroom. Theo excused himself and went to the bathroom. The brown prescription bottle was the only thing in the medicine cabinet other than disinfectants and some Q-Tips. The bottle was about half-full. â€Å"I'm going to take these with me,† Theo said, pocketing the pills. â€Å"The sheriff's deputies are going to ask you some of these same questions, Joseph. You just tell them what you told me, okay? Joseph nodded. â€Å"I think I should be with the girls.† â€Å"Just a bit longer, okay? I'll send up the deputy in charge.† Theo heard a car start outside and went to the window to see an ambulance pulling away, the lights and siren off. Bess Leander's body riding off to the morgue. He turned back to Joseph. â€Å"Call me if you need anything. I'm going to go talk to Val Riordan.† Joseph stood up. â€Å"Theo, don't tell anyone that Bess was on antidepressants. She didn't want anyone to know. She was ashamed.† â€Å"I won't. Call me if you need me.† Theo left the room. A sharply dressed plainclothes deputy met him at the bottom of the steps. Theo saw by the badge on his belt that he was a detective sergeant. â€Å"You're Crowe. John Voss.† He extended his hand and Theo shook it. â€Å"We're supposed to take it from here,† Voss said. â€Å"What have you got?† Theo was at once relieved and offended. Sheriff Burton was going to push him off the case without even talking to him. â€Å"No note,† Theo said. â€Å"I called you guys ten minutes after I got the call. Joseph said she wasn't depressed, but she was on medication. He came downstairs to have breakfast and found her.† â€Å"Did you look around?† Voss asked. â€Å"This place has been scoured. There isn't a smudge or a spot anywhere. It's like someone cleaned up the scene.† â€Å"She did that,† Theo said. â€Å"She was a clean freak.† Voss scoffed. â€Å"She cleaned the house, then hung herself? Please.† Theo shrugged. He really didn't like this cop stuff. â€Å"I'm going to go talk to her psychiatrist. I'll let you know what she says.† â€Å"Don't talk to anybody, Crowe. This is my investigation.† Theo smiled. â€Å"Okay. But she hung herself and that's all there is. Don't make it into anything it's not. The family is in pretty bad shape.† â€Å"I'm a professional,† Voss said, throwing it like an insult, implying that Theo was just dicking around in law enforcement, which, in a way, he was. â€Å"Did you check out the Amish cult angle?† Theo asked, trying to keep a straight face. Maybe he shouldn't have gotten high today. â€Å"What?† â€Å"Right, you're the pro,† Theo said. â€Å"I forgot.† And he walked out of the house. In the Volvo, Theo pulled the thin Pine Cove phone directory out of the glove compartment and was looking up Dr. Valerie Riordan's number when a call came in on the radio. Fight at the Head of the Slug Saloon. It was 8:30 A.M. Mavis It was rumored among the regulars at the Head of the Slug that under Mavis Sand's slack, wrinkled, liver-spot ted skin lay the gleaming metal skeleton of a Terminator. Mavis first began augmenting her parts in the fifties, first out of vanity: breasts, eyelashes, hair. Later, as she aged and the concept of maintenance eluded her, she began having parts replaced as they failed, until almost half of her body weight was composed of stainless steel (hips, elbows, shoulders, finger joints, rods fused to vertebrae five through twelve), silicon wafers (hearing aids, pacemaker, insulin pump), advanced polymer resins (cataract replace-ment lenses, dentures), Kevlar fabric (abdominal wall reinforcement), ti-tanium (knees, ankles), and pork (ventricular heart valve). In fact, if not for the pig valve, Mavis would have jumped classes directly from animal to mineral, without the traditional stop at vegetable taken by most. The more inventive drunks at the Slug (little more than vegetables themsel ves) swore that sometimes, between songs on the jukebox, one could hear tiny but powerful servomotors whirring Mavis around behind the bar. Mavis was careful never to crush a beer can or move a full keg in plain sight of the customers lest she feed the rumors and ruin her image of girlish vulner-ability. When Theo entered the Head of the Slug, he saw ex-scream-queen Molly Michon on the floor with her teeth locked into the calf of a gray-haired man who was screeching like a mashed cat. Mavis stood over them both, brandishing her Louisville Slugger, ready to belt one of them out of the park. â€Å"Theo,† Mavis shrilled, â€Å"you got ten seconds to get this wacko out of my bar before I brain her.† â€Å"No, Mavis.† Theo raced forward and knocked Mavis's bat aside while reaching into his back pocket for his handcuffs. He pried Molly's hands from around the man's ankle and shackled them behind her back. The gray-haired man's screams hit a higher pitch. Theo got down on the floor and spoke into Molly's ear. â€Å"Let go, Molly. You've got to let go of the man's leg.† An animal sound emanated from Molly's throat and bubbled out through blood and saliva. Theo stroked her hair out of her face. â€Å"I can't fix the problem if you don't tell me what it is, Molly. I can't understand you with that guy's leg in your mouth.† â€Å"Stand back, Theo,† Mavis said. â€Å"I'm going to brain her.† Theo waved Mavis away. The gray-haired man screamed even louder. â€Å"Hey!† Theo shouted. â€Å"Pipe down. I'm trying to have a conversation here.† The gray-haired man lowered his volume. â€Å"Molly, look at me.† Theo saw a blue eye look away from the leg and the bloodlust faded from it. He had her back. â€Å"That's right, Molly. It's me, Theo. Now what's the problem?† She spit out the man's leg and turned to look at Theo. Mavis helped the man to a bar stool. â€Å"Get her out of here,† Mavis said. â€Å"She's eighty-sixed. This time forever.† Theo kept his eyes locked on Molly's. â€Å"Are you okay?† She nodded. Bloody drool was running down her chin. Theo grabbed a bar napkin and wiped it away, careful to keep his fingers away from her mouth. â€Å"I'm going to help you up now and we're going to go outside and talk about this, okay?† Molly nodded and Theo picked her up by the shoulders, set her on her feet, and steered her toward the door. He looked over his shoulder at the bitten man. â€Å"You okay? You need a doctor?† â€Å"I didn't do anything to her. I've never seen that woman before in my life. I just stopped in for a drink.† Theo looked at Mavis for confirmation. â€Å"He hit on her,† Mavis said. â€Å"But that's no excuse. A girl should appreciate the attention.† She turned and batted her spiderlike false eyelashes at the bitten man. â€Å"I could show you some appreciation, sweetie.† The bitten man looked around in a panic. â€Å"No, I'm fine. No doctor. I'm just fine. My wife's waiting for me.† â€Å"As long as you're okay,† Theo said. â€Å"And you don't want to press charges or anything?† â€Å"No, just a misunderstanding. Soon as you get her out of here, I'll be heading out of town.† There was a collective sigh of disappointment from the regulars who had been placing side bets on who Mavis would hit with her bat. â€Å"Thanks,† Theo said. He shot Mavis a surreptitious wink and led Molly out to the street, excusing himself and his prisoner as they passed an old Black man who was coming through the door carrying a guitar case. â€Å"I ‘spose a man run outta sweet talk and liquor, he gots to go to mo' direct measures,† the old Black man said to the bar with a dazzling grin. â€Å"Someone here lookin fo' a Bluesman?† Molly Michon Theo put Molly into the passenger side of the Volvo. She sat with her head down, her great mane of gray-streaked blonde hair hanging in her face. She wore an oversized green sweater, tights, and high-top sneakers, one red, one blue. She could have been thirty or fifty – and she told Theo a different age every time he picked her up. Theo went around the car and climbed in. He said, â€Å"You know, Molly, when you bite a guy on the leg, you're right on the edge of ‘a danger to others or yourself,' you know that?† She nodded and sniffled. A tear dropped out of the mass of hair and spotted her sweater. â€Å"Before I start driving, I need to know that you're calmed down. Do I need to put you in the backseat?† â€Å"It wasn't a fit,† Molly said. â€Å"I was defending myself. He wanted a piece of me.† She lifted her head and turned to Theo, but her hair still covered her face. â€Å"Are you taking your drugs?† â€Å"Meds, they call them meds.† â€Å"Sorry,† Theo said. â€Å"Are you taking your meds?† She nodded. â€Å"Wipe your hair out of your face, Molly, I can barely understand you.† â€Å"Handcuffs, whiz kid.† Theo almost slapped his forehead: idiot! He really needed to stop getting stoned on the job. He reached up and carefully brushed her hair away from her face. The expression he found there was one of bemusement. â€Å"You don't have to be so careful. I don't bite.† Theo smiled. â€Å"Well, actually†¦Ã¢â‚¬  â€Å"Oh fuck you. You going to take me to County?† â€Å"Should I?† â€Å"I'll just be back in seventy-two and the milk in my refrigerator will be spoiled.† â€Å"Then I'd better take you home.† He started the car and circled the block to head back to the Fly Rod Trailer Court. He would have taken a back way if he could, to save Molly some embarrassment, but the Fly Rod was right off Cypress, Pine Cove's main street. As they passed the bank, people getting out of their cars turned to stare. Molly made faces at them out the window. â€Å"That doesn't help, Molly.† â€Å"Fuck 'em. Fans just want a piece of me. I can give 'em that. I've got my soul.† â€Å"Mighty generous of you.† â€Å"If you weren't a fan, I wouldn't let you do this.† â€Å"Well, I am. Huge fan.† Actually, he'd never heard of her until the first time he was called to take her away from H.P.'s Cafe, where she had attacked the espresso machine because it wouldn't quit staring at her. â€Å"No one understands. Everyone takes a piece of you, then there's nothing left for you. Even the meds take a piece of you. Do you have any idea what I'm talking about here?† Theo looked at her. â€Å"I have such a mind-numbing fear of the future that the only way I can function at all is with equal amounts of denial and drugs.† â€Å"Jeez, Theo, you're really fucked up.† â€Å"Thanks.† â€Å"You can't go around saying crazy shit like that.† â€Å"I don't normally. It's been a tough day so far.† He turned into the Fly Rod Trailer Court: twenty run-down trailers perched on the bank of Santa Rosa Creek, which carried only a trickle of water after the long, dry summer. A grove of cypress trees hid the trailer park from the main street and the view of passing tourists. The chamber of commerce had made the owner of the park take down the sign at the entrance. The Fly Rod was a dirty little secret for Pine Cove, and they kept it well. Theo stopped in front of Molly's trailer, a vintage fifties single-wide with small louvered windows and streaks of rust running from the roof. He got Molly out of the car and took off the handcuffs. Theo said, â€Å"I'm going to see Val Riordan. You want me to have her call something in to the pharmacy for you?† â€Å"No, I've got my meds. I don't like 'em, but I got 'em.† She rubbed her wrists. â€Å"Why you going to see Val? You going nuts?† â€Å"Probably, but this is business. You going to be okay now?† â€Å"I have to study my lines.† â€Å"Right.† Theo started to go, then turned. â€Å"Molly, what were you doing at the Slug at eight in the morning?† â€Å"How should I know?† â€Å"If the guy at the Slug had been a local, I'd be taking you to County right now, you know that?† â€Å"I wasn't having a fit. He wanted a piece of me.† â€Å"Stay out of the Slug for a while. Stay home. Just groceries, okay?† â€Å"You won't talk to the tabloids?† He handed her a business card. â€Å"Next time someone tries to take a piece of you, call me. I always have the cell phone with me.† She pulled up her sweater and tucked the card into the waistband of her tights, then, still holding up her sweater, she turned and walked to her trailer with a slow sway. Thirty or fifty, under the sweater she still had a figure. Theo watched her walk, forgetting for a minute who she was. Without looking back, she said, â€Å"What if it's you, Theo? Who do I call then?† Theo shook his head like a dog trying to clear water from its ears, then crawled into the Volvo and drove away. I've been alone too long, he thought.

View from a Bridge Arthur Miller Essay Choose a play in which there is a scene involving intense emotion. Show how the dramatist makes you aware of the intensity of the emotion in the scene and discuss the importance of the scene to the drama as a whole. In his play A View from the Bridge, Arthur Miller successfully conveys to the audience the tensions, jealousy, hostility and raw emotions between the characters in one particular scene at the end of Act 1 in his play. A View from the Bridge centres round the Carbone family who stay in Brooklyn New York, Eddie the head of the family is an ordinary man part of the local Italian community who is master in his own house. Eddie believes that it is a mans place to look after and protect his family and as head of the household he is used to laying down the rules. Eddie and his wife Beatrice take on the responsibility of looking after Eddies late sisters daughter Catherine who Eddie brings up as if she was his own but it soon becomes clear that Eddies feelings are deeper than those of a protective uncle, he is in love with his niece. The arrival of two of his wifes relatives from Italy, Marco and Rodolpho is at first welcomed by Eddie, he is happy to hide the illegal immigrants. However when Rodolpho starts to show an interest in Catherine, Eddie becomes increasingly jealous and hostile towards both men, in particular Rodolpho, but he bottles up his feelings. At the end of the first Act things come to a head and his jealousy, hostility and obsession with Catherine is made obvious when he finally realises that his efforts to stop Catherine and Rodolpho marrying are going nowhere. Eddie resorts to violence under the pretence of teaching Rodolpho to box merely as an excuse to hit him. Forced to watch Catherine and Rodolpho getting close as they dance together Eddies sarcastic comments about Rodolphos manliness clearly show his hostility to Rodolpho He sings, he cooks, he could make dresses I cant cook, I cant sing, I cant make dresses, so Im on the water front. But if I could cook, if I could sing, if I could make dresses, I wouldnt be on the water front. The stage direction tells us that Eddie has been unconsciously twisting the newspaper he is tense, like a spring waiting to uncoil and this finally happens and things are brought to a head when he offers to teach Rodolpho to box and what starts out as a seemingly harmless sparring session leads to Eddie hitting his opponent with needless force a fact which is noticed by everybody in the room. Marco rises from his seat and Catherine quickly rushes to Rodolphos side Eddie aware that he has taken things a step to far and tries to cover his tracks by saying that he punched too hard by accident I didnt hurt him. Did I hurt you, kid? However Eddie has overstepped the mark and in an attempt to humiliate Rodolpho he angers Marco who is careful not to verbally threaten his host, actions speak louder than words. Marco challenges Eddie to lift a chair when it is in a certain position but Eddie fails the challenge. Marco then successfully lifts the chair above his head powering over a frightened Eddie. The stage directions describe Marco as He kneels, grasps and with strain slowly raises the chair higher and higher, getting to his feet they go on to describe how Marco is face to face with Eddie, a strained tension gripping his eyes and jaw, his neck stiff, the chair raised like a weapon over Eddies head-and he transforms what might appear to be a glare of warning into a smile of triumph Marco is obviously giving a warning to Eddie to not continue to mess around, and make fun of his brother by showing him the danger he invites. The audience can tell at once that this is a very dramatic point in the play; Catherine and Rodolpho who have resumed dancing immediately stop. The stage direction Rodolpho and Catherine have stopped dancing in the middle of this hostile situation shows that they are aware that Marco has also taken things a little too far. Miller also describes Eddie when Marco is glaring at him His grin vanishes as he absorbs his look this action by Eddie clearly shown both Marco and the audience that Marco has achieved what he set out to do, give Eddie a warning and this is highlighted by the fact that as soon as Eddies expression turns to one of fear Marco looks at him and his own expression changes into a victorious smile. The feelings revealed in this act of the play an important part in the relationships between the characters in the remainder of the play. The hostility and anger felt by Eddie magnifies. Eddies obsession with his niece finally leads him to hit Rodolpho when he becomes aware that the two have slept together. In the end Catherine finally decides to marry Rodolpho and Eddie decides that he has no choice but to inform the Immigration Bureau that he has been hiding two illegal immigrants. Eddie takes this action despite earlier comments that Its an honour to give the men refuge. In breaking his code of honour Eddie loses everything the respect of his neighbours, his friends and his family and in the final scenes of the play he comes head to head with and angry and betrayed Marco, cowardly brandishing a knife Eddie attacks Marco but in self defence Marco turns the knife on Eddie fatally stabbing him. Arthur Miller cleverly sets the tone of the play during the hostile scene in Act 1. The domestic harmony that exists at the start disappears and the audience learns quickly about Eddies obsession and his obvious frustration and anger towards his nieces admirer. Miller uses stage direction to show the audience the true extent of the raw emotions felt by the characters and to show the drama and crisis which finally climaxes in the death of the main character. Impact of Social Classes Essay The world that we live in is so immense, that the people who live in it is so diverse in culture, lifestyle, language and even skin color. We live in different environments and countries yet with all these dissimilarities, we share something in common. That is what we call social classes, which was practiced primarily during the beginning of world civilization. Our world began with this system and thereby influenced the generations after them. People were then identified simply as slaves or kings yet very unjust. People eventually awakened from a lengthy stupor and learned to fight for their human rights to exterminate these social strata and discriminations that exist in the society even until today. It is sad but factual and real. Even in the most democratic country, social classes still exist in modern times and manifest in terms of financial, cultural ethnicity and even racial aspects. We still have what we call as upper, middle and lower classes basing on their financial capacity. It is really part of our world but we have grown to be more considerate and tolerant to each other. In the story AP, the setting of the story happened in a store in a small town five miles away from the beach. People here are generally conservative thus concerned about propriety. The story began when Sammy, who worked as a cashier in this grocery store called AP saw three young girls who came in the store barefoot, wearing swimming suits. This of course does not occur everyday in this town, so naturally, Sammy and his co-worker Stokesie were stunned. Even the other grocery shoppers were surprised to these girls confidently walking along the aisles looking for something they need to buy. When the girls were on the counter being manned by Sammy, they caught the eye of Mr. Lengel, who manages the store. Mr. Lengel who also teaches Sunday school could not help but approach the girls and told them â€Å"Girls, this isn’t the beach. † This embarrassed the girls and one of them said, â€Å"We are decent†. The girls then paid and hurried to go back to their car outside and leave. Before the girls left, Sammy suddenly told Mr. Lengel that he is quitting his job, deliberately saying it while the girls were of hearing range to present himself as their hero but when he left the store, the girls left already, putting his efforts to nothing. Sammy then realized that his impulsiveness led his to lose his job which can greatly affect his life and his family. Living in different areas in the same country also means having diverse cultures. Urban areas especially the big cities have displays of a more liberated lifestyle compared to the rural ones. The contrasts of these two societies are very apparent in this story. These girls didn’t think they did anything wrong by walking in a store wearing swimming suits but for residents of that community, it was very improper and offensive. Sammy seemed in awe of these girls and impulsively quit his job just to become a momentary hero for them. Seeing this trio of girls who have been used to a different upbringing due to a social class they grew in opened Sammy’s eyes to something different from the one he is used to. The second story was entitled â€Å"Barn Burning† which happened in the 1930’s. It was about an impoverished family led by the father called Abner Snopes, who works for farmers in way of rental contracts. This family has been moving from one farm to another for several years because Abner always gets in trouble. Abner is so full of bitterness and insecurities that pushed him to do ludicrous deeds to the farm owners he works in. His temper heats up even with the slightest provocation and gets consumed with hatred which impels him to burn the barns of the farms who worked for. All these were done witnessed by his two sons, twin daughters, sister-in-law and his wife who tags along with him every time he needed to move. He was put in question in Peace’s courts several times because of his arsonist tendencies. One time, he burned a barn to get back at his neighbor named Mr. Harris because his hog strayed to his neighbor’s property and defiantly refused to return it if he would not pay the fine of a dollar. He then sent a black man whom he calls rudely as a nigger and asks him to pay the dollar to claim his hog and tell the neighbor, â€Å"Wood and hay kin burn. † Later the barn of that neighbor was burned. After the inquest the Snopes family had to move to another farm outside that county. When they arrived at another farm, he immediately paid a visit to the owner of the farm and insisted on going inside the white carpeted house with his filthy shoes and smeared dung on it from his shoes. He was later told in court to pay the farm owner ten bushels of corn which he obviously could not afford since they can barely put food on their table. He then later decided to burn the barn of that farm owner for revenge. The only person in the Snopes’ family, who truly asserted himself to correct the misdeeds of his father, was Abner’s youngest son who was a little boy named Colonel Sartoris Snopes. He wanted his father’s habitual barn burning to be stopped and so told the farm owner of what was happening. Colonerl Sartoris was righteous and did what he believed was the right thing to do even if his father’s barn burning is revealed. I am not trying to defend but understand Abner for the things he did in the story. What he did was wrong and there was no just compelling for his actions but Abner’s behavior was in some ways a result of what society laid as basis for a person’s worth. He became irrational and resorted to violence when he thought he was unfairly treated instead of trying to do things in a proper way. Social classification then was so vividly observable. The owners of a farm are far more affluent compared to the families in the likes of the Snopes’ who does the hard, laborious work of tilling the land, growing the crops then harvesting it yet earning so little for it. The unfairness of that era was evident and created a huge gap between these social classes which affects the lives of those considered as inferior like Abner’s family. They deserved equal opportunity to live a more comfortable and easy life. Sammy and Abner has the same impulsiveness to do what they think could put justice into a situation without thinking of the consequences of their action. Sammy quit his job to show that he dissented the way Mr. Lengel embarrassed the girls which was implied to be a decision that would affect his family. On the other hand, Abner resorted to violence to solve his predicament which apparently worsens his family’s situation. Social stratification affects the lives of the people. It may enrich their lives or curtail their opportunities. These days it is a relief to see that the lines between these classes are not as vivid as during the time of our forefathers and are now slowly fading into progression. There are still destitute men and women on the streets in most communities. There are still discriminations among races and gender. There are still people oppressed by their leaders. But it is evident that in our society today people are more aware of their rights and would definitely fight for it in whatever way they can. These stories showed the development in how people treated each other during these two eras and the history of social classes.

Market research aims to find out customers needs and views on new products and services also old products and service, Promotional Activities is because businesses need to promote their products and services otherwise customers would be aware that they exist, the range of available methods including advertising, sales promotion etc, sales, merchants are employed by companies making house hold products to visit supermarkets to persuade them to stock their brands. The advantages of the marketing and sales department is that they will research information find new trends that will sell, also promote products that are attractive as well as best selling. The problems that occur within the marking and sales department are the research being wrong so instead of profit they lose, products could be out of date and rotten also the advertisements for a product will cost money The marketing and sales department helps achieve the aims and objective of EA^T by making profit margins larger and to increase stock if products sell fast and by that happening it could happen it could help them reach their target price. Russian House Since the 1851 Great Exhibition, world's fairs have always attempted to celebrate cultural diversity. In pavilions, participating countries promoted their natural resources and industrial products, while celebrating their national identity. However, not all cultures could be accurately portrayed. These exhibits did not prevent negative stereotypes about other people's cultures for persisting. Stereotyping almost became an art form, and was particularly apparent at the 1889 World's Fair in Paris, where specific buildings were built to exemplify architectural stereotypes of different countries. As part of an exhibition called L'Histoire de L'Habitation Humaine or History of Human Habitation, which was the creation of architect Charles Garnier. Many of these small structures related to remote and "exotic" locations around the world. One of the countries that received the exotic treatment was Russia, despite this country's political power. Charles Garnier was born in 1825 and studied architecture at the Paris Ecole des Beaux-Arts. After he was awarded the Grand Prix de Rome in 1848, he went to study architecture in Italy. In 1860, Garnier won the competition for the new Paris Opera House, which was not completed until 1875 and remains his most important commission. His other works include villas he built in Bordighera, Italy, an Observatory in Nice, the Cercle de la Librairie in Paris, and many very famous works in Monte Carlo, including a casino resort. Charles Garnier was also a self-appointed expert in world cultures and their architecture. My Philosophy of Teaching Essay -- Philosophy of Education Teachers Es

My Philosophy of Teaching In the field of education there could arise many philosophical ideas of each individual teacher. Many of the past philosophies have been and still are used in today’s education programs, such as the Socratic method. My philosophy will also contain some of the many philosophies of the past and possibly the future. I will state the nature of students, the nature of knowledge, the purpose of public education, method, and curriculum according to my own philosophies, which also may be based the philosophical ideas of previous individuals. The nature of human beings in my opinion, as well as Jean-Jacques Rousseau, is that all human beings are born innocent. We are born into the world without the knowledge that is to be acquired throughout time. When it comes to the nature of knowledge however I do not agree with Rousseau. I believe that each person should construct his own knowledge at the same time as he memorizes other knowledge. In other words, the student should learn and memorize what he has been taught; yet at the same time hold his own opinions and philosophies in mind as well. I believe that the nature of knowledge is also purely relative; it does depend upon the person, place, and time. Not every student is going to be the same. One might not be able to learn in a larger classroom than another might; he may require special attention possibly for the reason that he may have a learning disability, or possibly a short attention span. The overall purpose of education in my opinion is for survival in today’s society and economy. For one person to survive comfortably in this computer –based world of today, one would require skills in mathematics, English, science, and ma... ... retain the lessons. From past experiences I have observed that if the teacher involves the students in the lesson, the children forget that they are learning and realize that they are having fun. This area of participation is important in elementary schools for the purpose of accomplishing the goals in which almost every school sets forth. It also allows the children to feel in control of their thoughts and opinions. My professional development plans include a wide variety of experiences with children in general and in the education field. In the above paragraphs, I have made it clear what my expectations are in terms of the nature of students, the nature of knowledge, the purpose of education, method, and curriculum. I do however, expect them to be subject to change after I have completed the required field experience or my own professional experience. Introduction XXXXXX XXXXXX is a registered charity offering work based learning programmes to young adults.Within my role as Advanced Teaching Practitioner, I am responsible for curriculum design, monitoring teaching, staff training and mentoring, quality assurance and learner achievement in addition to my role as a Basic Skills Tutor. Before analysing current practices, I have gained the consent from those directly involved. In order to assess current inclusive learning principles and practices of the organisation, I need to increase my understanding of inclusive learning for my own Continued Professional Development (CPD).I need to reflect of my own practices and the practices of others and evaluate the service provided. Findings What is Inclusive Learning? Inclusive learning can be defined as ‘the greatest degree of match or fit between the individual learners’ requirements and the provision that is made for them’ (FEFC, 1996, p2). Inclusive teaching means recognising, accommodating and meeting the learning needs of all students and being aware of their individual needs. It is about identifying the reasonable adjustment that can be made without it having a negative impact of the teaching and learning of others.Open University Press (2006) defines inclusive learning as ‘acknowledging your students have a range of individual needs and are members of diverse communities. Inclusive teaching avoids pigeonholing students into specific groups with predictable and fixed approaches to learning’. It is important to consider the need to be proactive as opposed to being reactive. To practice inclusive learning, act ions need to be taken prior to students commencing the process.The Tomlinson report 1996 states: ‘Re-designing learning, assessment and organisations to fit objectives and learning styles may mean introducing new content to courses, adapting access or both. This approach is quite different from offering courses and then giving students with difficulties some additional human or physical aids to participate. ’ Under the Special Education Needs and Disability Act (SENDA) 2001, all educational establishments must not treat students less favourably than others and make reasonable adjustments to ensure that their learners are not substantially disadvantaged.Learning Environment An accessible and safe learning environment is vital for inclusive learning to take place. The premises that XXXXXX XXXXXX occupy are located on the second and third floor of a listed building. There are no lifts and there is a staircase leading up to the main reception. Under the Disability Discrimin ation Act, there is a requirement to make reasonable adjustment to be able to ensure those students with a mobility disability are not excluded. XXXXXXhave made contingency plans whereby they use the premises within a local college as and when required.SENDA 2001 states that students should be able to access all services provided for other students. In this case, the local college offers all the facilities and services we offer our students. Taking this into consideration, reasonable adjustments have been made. Access for all In order to give strategic direction to inclusive learning, Smith and Armstrong (2005, p1) state ‘providers need to adopt a co-ordinated approach to inclusive learning, working with different groups, genders and levels of learners’. These is achieved ongoing within XXXXXX XXXXX.There is no discrimination on the grounds of gender or sexual orientation within XXXXXX XXXXXX and therefore XXXXXXcomply with all aspects of the Sex Discrimination Act 1975 . Our learners come from mixed race, religion and in order to ensure that we accommodate these learners, all staff receive multifaith calendars to ensure that they can manage their learning over religious or cultural holidays. As we are funded for a 14-19 age provision, we cannot offer learning to anyone outside this age range. This is a limitation by DCELLS.Should anyone outside this age range require the same type of education and training, there are other training providers where they can be signposted. McGivney (2003) guidelines suggest that people with disabilities, ex-offenders, low paid unqualified workers, male manual workers, unemployed groups, rural residents, women with young children, homeless and those from ethnic minority groups may have problems in participating in organised learning activities. (DCSF, 2008) states ‘9% of young people aged 16-19 are Not in Education, Employment or Training (NEET).As part of the ‘Every Child Matters Agenda’ their aim is to break down the barriers to achievement and provide opportunities for those disengaged from learning. This agenda intends to ensure that programmes have been set up to identify children and young adults at risk and promote early intervention. According to the 14-19 Education and Skills White Paper ‘those with learning difficulties are twice as likely to become NEET’. XXXXXX XXXXXX have recently established street based youth work teams; across communities in south Wales, working with partner organisations to engage some of the hardest to reach young people; nd to progress them onto positive development opportunities in their own communities. The current teams are a pilot and are hoping to expand the project into other geographic and sector communities. XXXXXX XXXXXX are also establishing links to deliver full and part time extended curriculum services in schools for 14-18 year olds across Wales, providing support for young people in the youth justice system; estab lishing a youth drop in facilities at many centres and expanding the street based youth work.XXXXXXare also in community cohesion work particularly in areas with a large European migrant youth communities and those with a migrant non-welsh speaking community within Welsh speaking indigenous communities. XXXXXXis piloting development of youth volunteering in under-represented groups. Taking all this into consideration, it shows the effort that is being made in order to provide inclusive learning to those students who are at risk of becoming NEET. Inclusive Learning in Initial Assessment According to Green and Bartram 1998, p7) ‘Early and effective assessment of students’ requirements is critical to the concept of inclusive learning.There are three stages to the initial assessment process within the organisation. Prior to a learner joining they go through an initial assessment process. This begins with an informal interview following an endorsement from Careers Wales. In this interview, it allows the organisation time to carry out an informal assessment and identify individual learning needs. On entry, basic skills initial assessments and a VARK learning styles questionnaire are completed. From this process, an Individual Learning Plan (ILP) is written that is specific to the needs of the learner which will identify individual goals.Green and Bartram (1998. p10) outline that in order to achieve best practice; there should be ‘a common and shared understanding of the purpose of initial assessment’. Through discussion with staff and observations of the initial assessment process, it is evident that this there is a thorough initial assessment process which allows many opportunities to identify any individual needs and preferences. Following this process, if a learner is identified as having a literacy or numeracy need, diagnostic assessment is carried out.Learners have the opportunity to do these either by paper based methods or using Info rmation Technology (IT). The results of this assessment then produce an Individual Learning Plan that is specific to the learners literacy and/or numeracy needs and takes into consideration any special arrangements that may be required. Inclusive learning in the classroom If there has been an individual need identified through initial assessment, it is at this point XXXXXX XXXXXX are reactive as appose to being proactive. For those with physical disabilities, arrangements are made to support them.As previously discussed there is a lack of facilities within the centres to support learners with a disability affecting mobility and this is taken into consideration when careers signpost learners. Apart from this, Rooms are bright, well ventilated and are small enough to be able to accommodate those with minor hearing or visual impairments. When considering students who are deaf and hard of hearing, XXXXXXdo not have a strategy in place for dealing with those who require specialist suppor t including lip speakers, sign language interpreters and speech to text reporters.Although many learners who require this support often plan their own support requirements. To ensure inclusion in the classroom, it should be considered when planning lessons. Once the aims and objectives have been decided, it is then important to consider the needs and previous experiences of the learners’. At this stage, you can consider if there are any adjustments that can be made to ensure that the lesson is inclusive Open University Press (2006). This could be large print handouts, varied teaching strategies, practical tasks as appose to written, aural or visual methods and where possible, taking into account multi sensory learning.When carrying out questioning in the classroom, there was very good use of reinforcement techniques to consolidate learning. Although tutors encouraged all members of the group to participate, this was done in such a way that no learners felt uncomfortable. When this was necessary (e. g. a speaking and listening task) it was managed in a positive way to recognise individual needs. If learners need support with basic skills, subject specific tutors (NVQ, Key Skills) liaise with the Basic Skills Tutor to organise extra support in addition to their literacy and/or numeracy classes.If the learner has a learning difficulty that affects concentration, extra comfort breaks can be given and short activities should also be planned that vary in teaching strategy to keep learners engaged. At present, DCELLS are working towards converged basic and key skills. This initiative should have encourage a more standard approach as qualifications will be delivered in a different training and staff will be required to update their CPD. Practices vary depending on the experience of individual tutors within XXXXXX XXXXXX.When observing a key skills session, a tutor suggested to her group that it would be advantage to take notes whilst completing practical activi ties. On her lesson plan, she had shown inclusive practices by suggesting a Basic Skills Tutor could offer support with both reading and note taking if required. In terms of the use of classroom assistants or support workers, this is the only instance that in class support is offered due to staffing levels within the organisation. The majority of tutors promote equal opportunities practices by having notes available at the end of the lesson for all learners.Others show inclusive learning techniques by issuing gapped handouts at the beginning of the lesson to support those with individual needs. This later method allows those learners who have lack of confidence in groups, those with hearing difficulties or partial sight a greater chance of achieving the objectives set from the lesson. Experienced staff uses assistive technology in the classroom such as coloured acetate, worksheets on coloured paper or magnifying equipment to support learners when reading books, but once again staff training is needed to ensure consistency throughout the organisation.Smith and Armstrong (2005) suggest providers should make sure that CPD and staff training supports structures and systems implemented to deliver the inclusive learning agenda. Through discussion with staff, it is evident that staff members have little knowledge of how to support learners with Dyslexia, Attention Deficit Disorder (ADD), Attention Deficit Hyperactive Disorder (ADHD) and other learning and behavioural needs. Therefore staff CPD needs to be updated and staff training offered. Having observed a selection of basic skills sessions, I have seen differentiation being managed very well within the classroom.There are isolated cases where worksheets have been the main teaching strategy due to the diverse nature of the group but the main reason for this is the need for staff development and training. Within sessions, individuals show good inclusive learning techniques when giving feedback. They are constructive and give praise for what has been done well and avoid being negative to learners. For those who have physical disabilities, there is IT equipment available such as specialist mouse and the ability to increase the font size on the majority of programmes used.If there is a need for out of class support, this is also available from the training assessors responsible for the individual learners. Individual training assessors are encouraged to spend time with all learners to build a rapport and encourage them to discuss any individual learning needs. These persons are trained to signpost for guidance and counselling if required. Assessment Once learning has taken place, there are various methods of assessment that are used. Within basic skills, learners are given a choice of completing assignments which are paper based or tests that can be taken using IT.For those who have to submit a portfolio, they are given the option of using IT to produce their work. There are also dictaphones avai lable to record case studies, professional discussions or oral questioning as appose to written questions. These strategies in place show differentiation for individual needs are being considered. As well as the usual methods of assessment, learners also get a review which is carried out every four weeks. In this review, their progress is monitored and feedback is given on their performance.The Tomlinson Report (1996) shows us that monitoring progress and providing effective feedback contributes to effective inclusive teaching. Within their basic skills support sessions, further feedback is also given as part of their literacy/numeracy ILP. All learners at the end of their visits are given a Training And Support Log (TASL) which gives them feedback on any work produced. Conclusion Following this investigation, I have reached the conclusion that the organisation is reactive as appose to proactive with regard to inclusive learning.As a training provider, XXXXXX XXXXXX are genuinely no n-selective about the learners who complete a programme. Many of the learners face a number of obstacles to engaging in learning including low educational attainment, a lack of basic and/or personal skills, caring obligations, homelessness, lack of self belief, confidence and self worth. Despite this, over 70% of the young people that are supported leave with a positive outcome. The 14-19 Education and Skills White Paper state that 12. 5% of the NEET group have learning difficulties and/or disabilities.If XXXXXXtraining wishes to continue aiming to offer inclusive learning and reduce this NEET cohort, there is a need to train staff by offering CPD in inclusive learning and ways of developing an inclusive learning strategy within the learner process. There are different teaching approaches within the organisation. (Tilstone et al. ,1998, p. 6) states ‘a key issue in promoting inclusive practice must be a reappraisal of the training provided to teachers and other professionalsâ €™ From my observations, I feel that this is an accurate assumption to make.I have been able to observe many sessions over a period of time and have seen that tutors need training on how to incorporate inclusive learning strategies within their lesson plan. Smith and Armstrong (2005) also discuss how providers should establish a strategy for sharing best practice within an organisation. XXXXXXhave meetings for every subject route on a quarterly basis. Although this is an excellent way of sharing best practice, inclusive learning should be listed as an agenda item to ensure that it gets the attention it requires.Although everything is done during the learner process to ensure that equal opportunities and diversity are managed, XXXXXXhave a bullying and harassment procedure in place and also a grievance procedure that prospective, current and past learners can instigate if they wish. From carrying out research into inclusive learning within XXXXXX XXXXXX, it has been shown that on the whole, a lot of work goes in to meeting the individual needs of the learner and offering a positive learner experience.Having now completed this research, it has made me aware of the financial restraints of the organisation. I feel that I will carry out my role as ATP differently when training staff and mentoring. When working towards curriculum design, I will also ask myself the question â€Å" How can I make it more inclusive? † and from this, I feel that this has played a big part in my CPD.
